Centre for Environmental Law is happy to launch NATIONAL GREEN NEWS, with the current enviro-legal news. A clean, healthy environment is essential to the realization of the fundamental right to life, personal integrity, family life, health and development. Environment is the resource base for all life and it needs to be protected. Immediate action is required from the Government and its various bodies, by introducing new guidelines or amending existing laws to eradicate the environmental degradation problem in our country. CHANGE is the need of the hour. This newsletter will focus on such news articles and bring them to you every month.

Green tribunal orders closure of 34 illegal packaged drinking water units in Noida, Greater Noida

The National Green Tribunal has ordered the closure of 34 packaged drinking water units in Noida and Greater Noida for extracting ground water and operating illegally. The tribunal has also extended the ban on extraction of groundwater for construction purposes in Noida and Greater Noida till March 21.

Green notice to government on Rajokri roads

Taking suo moto cognizance of a report on the illegal construction of three roads inside the Rajokri Forest, an application has been filed with National Green Tribunal (NGT). The environment watchdog has now sent notices to the Delhi government and other agencies concerned.

Steps taken to regulate use of air horns, Transport Commissioner informs tribunal

All steps were being taken to curb noise pollution caused by high-decibel air horns used by vehicles in the State, the Transport Commissioner submitted before the National Green Tribunal, Southern Bench on Friday. The Bench comprising its members Justice M. Chockalingam and Prof. R. Nagendran took suo motu cognisance of a matter after receiving a letter from one A.M. Joseph to ban the use of high decibel air horns.

Delhi Metro in soup for polluting Yamuna river

The Delhi Metro has been issued a show-cause notice for dumping debris into the Yamuna, adding to pollution. The notice issued by the National Green Tribunal (NGT), states that Delhi Metro Rail Corporation (DMRC) has contributed to the encroachment on the riverbed.

SC allows MoEF to delink environment, forest norms

In a major relief to the stalled highway projects, the Supreme Court on Tuesday allowed the Ministry of Environment and Forests (MoEF) to modify its norms to delink environment clearance from forest clearance. This is likely to resolve the contentions between the MoEF and the National Highway Authority of India (NHAI). A Forest Bench led by Justice Aftab Alam allowed an application by the MoEF seeking a liberty to de-link the two clearances for the purposes of road projects, subject to fulfillment of certain conditions stipulated by the MoEF in its January 7 letter.

The national green tribunal (NGT) on Tuesday issued a notice to the Goa state pollution control board (GSPCB), other government authorities and Sesa Goa on a complaint lodged by village panchayat of Navelim-Bicholim over pollution in the village by the pig iron plant of the company.

Green tribunal to decide on waste management plant

The issues pertaining to setting up of a solid waste management plant at Jhuriwala village, near Panchkula, and shifting of a site for solid waste from Sector 23 will now be decided by the National Green Tribunal. It is a body constituted for effective and expeditious disposal of cases relating to environmental protection. The Punjab and Haryana high court on Wednesday referred both the issues to the tribunal for adjudication. At present, the entire garbage of Panchkula is dumped in Sector 23 because of which residents complain of foul smell.

The Supreme Court Friday took Maharashtra, Madhya Pradesh and West Bengal governments to task for not providing office infrastructure and other facilities necessary for the functioning of Pune, Bhopal and Kolkata benches of the National Green Tribunal.

Green tribunal stays PWD road widening

The National Green Tribunal has ordered an interim stay on PWD's road-widening project along the Andheria Mod-Mahipalpur stretch, where trees were found to be felled illegally. On Monday, a bench headed by NGT chairman Justice Swatanter Kumar, asked the Delhi government, the forest department and PWD to "not fell any tree except in cases where permission from the department concerned has been obtained till the next date of hearing, and also produce records if the non-applicants have obtained the necessary clearance or permission from the forest department for removing or felling the trees while making the road". Notices have been issued to all three departments.

Rajasthan High Court quashes state mining policy favouring masonry stone miners

The Rajasthan High Court has quashed a state government policy that granted mining leases for sandstone and masonry stone in four villages of Jodhpur tehsil. The court order of March 13 termed the policy as discriminatory. The case details of 19 writ petitions presented in the Jodhpur seat of the high court show that the state government changed the mining policy to favour masonry stone miners over sandstone miners in four villages-Bujhawad, Choukha, Gangana and Rohila Kallan.

Green tribunal asks committee for proposal to develop banks of Yamuna

The National Green Tribunal has directed a committee set up by it to implement its order banning dumping of debris on the banks of Yamuna, to submit a proposal for the development of the river's banks. A bench headed by NGT chairperson Swatanter Kumar has given the panel time till the next date of hearing on April 23 to present the proposal before it.

MoEF contests green tribunal order on fresh site inspection of Nirma cement plant

It is still undecided whether a fresh site inspection of the Nirma cement plant in Gujarat's Bhavnagar district is required. Despite two committee reports stating that the land on which the detergent company is setting up a cement plant is a wetland, the National Green Tribunal (NGT) had directed that a site visit be carried out by its expert committee on February 19.

Now, any citizen can move National Green Tribunal to report violations

Violations of green norms and clearances can be appealed against by any citizen and not just someone directly or indirectly affected by a project, the National Green Tribunal has held, widening the scope of green litigation in the country. The tribunal has also put in mandatory obligations on the government and project developers to disclose details of clearances. Both have avoided doing so in many cases till now.

Supreme Court to decide fate of Sterlite's Tuticorin plant Tuesday

The Supreme Court will on Tuesday pronounce its verdict on the fate of the Sterlite Industries' copper smelting plant in Tamil Nadu's Tuticorin, which was ordered to halt its operations in 2010 by Madras High Court for violating environment norms. The verdict will be pronounced by a bench of Justice AK Patnaik and Justice HL Gokhale.
