Centre for Environmental Law is happy to launch NATIONAL GREEN NEWS, with the current enviro-legal news. A clean, healthy environment is essential to the realization of the fundamental right to life, personal integrity, family life, health and development. Environment is the resource base for all lives and it needs to be protected. Immediate action is required from the Government and its various bodies, by introducing new guidelines or amending existing laws to eradicate the environmental degradation problem in our country. CHANGE is the need of the hour. This newsletter will focus on such news articles and bring them to you every month.

Few in state know they can move National Green Tribunal

A stakeholders meet to analyse the workings of National Green Tribunal (NGT) in western India bench was organized at the Tribal Research Centre of Gujarat Vidyapith. The major objective of the meet was to study the interventions of NGT in cases related to Gujarat and also study why people still the depend on PILs and writs. Experts argued that awareness about who all can approach NGT was not there.

Demarcation by mid-October, forest department tells National Green Tribunal

The forest department has assured the national green tribunal (NGT) that the process of identifying and demarcating private forests in Salvador do Mundo will be completed probably by August in fair-weather conditions or if not, by mid-October. NGT had directed the government in an order in November 2013 to identify private forests shown as natural cover in the Regional Plan (RP) 2021 in connection with an application filed by citizens raising apprehensions about the destruction of green cover in the village.

Gujarat govt "not implementing" National Green Tribunal orders on clean environment, alleges eco-group

Paryavaran Mitra, Gujarat's environmental groups, has taken strong exception to the refusal of the Gujarat government to comply by orders of the National Green Tribunal (NGT) in cases fought with its active support. Prepared by Gujarat Social Watch, operating under the auspices of Paryavaran Mitra, its latest study, "Assessment of working of National Green Tribunal (NGT): With special reference to cases from Gujarat and western region bench of Pune", has cited two such cases where the state officialdom has shown particular inertia.

Green tribunal orders builder to stop mining near wildlife sanctuary, shut hotmix plant

National Green Tribunal (NGT) has ordered influential Madhya Pradesh builder Dilip Suryavanshi's company, Dilip Buildcon, to stop mining operations in the vicinity of the wildlife sanctuary in Ratlam district. The tribunal has also asked the company to shut its hotmix plant immediately. The company was awarded the contract to construct 87.77 km road in Ratlam district of the state by Madhya Pradesh Road Development Corporation Limited Bhopal ( MP).

National Green Tribunal order delays Noida flats

Almost 20,000 homebuyers in Noida face a delay in receiving possession of their completed apartments. This is due to a recent judgment by National Green Tribunal, which prohibits Noida Authority from giving any completion certificate for projects within a 10km radius of Okhla Bird Sanctuary.

National Green Tribunal to Review Ban on Coal Mining in Meghalaya

The National Green Tribunal will hold a meeting in Shillong on Monday to review its order banning coal mining in Meghalaya. Coal mining has been going on in Meghalaya since early 19th century, but says estimates by the government, illegal mining has mushroomed across the state in the last two months. Most mines here are of the 'rat hole' variety -- small pits are dug in the ground and people crawl into these pits with next to no safety equipment. The Tribunal had imposed a ban on mining as most such activities are illegal, dangerous and extremely polluting.

Green tribunal permits sale of extracted coal

The National Green Tribunal extended the ban on 'rat-hole coal mining' in Meghalaya till August this year but permitted sale of coal that already has been extracted. The tribunal's special circuit bench, eastern zone, held its hearing at Meghalaya High Court in Shillong and was chaired by Justice Swatanter Kumar and former Meghalaya Chief Secretary and expert member Ranjan Chaterjee passed the order.

Rajasthan farmers move green tribunal over contaminated canal water

Perturbed over supply of contaminated canal water to Rajasthan and alleged callous attitude of Punjab government to check its quality, Hanumangarh-based progressive farmers Shobha Singh Doodi and Shabnam Godara have filed a petition with the National Green Tribunal (NGT). The petitioners have sought a check on supply of "highly contaminated" canal water from Punjab to Rajasthan. The petition has also listed Union ministry of environment and forests as the defendants.

National Green Tribunal: An Environmental Justice experiment

Created by an act of parliament in 2010, the National Green Tribunal was established as a dedicated fast-track court to deal with environmental disputes throughout the country. Its specific mission is "the effective and expeditious disposal of cases relating to environmental protection and conservation of forest and other natural resources." Decisions made by the tribunal can only be challenged in the Supreme Court. The principal bench is based in New Delhi, with circuit benches in other cities across the country so that it can reach remoter parts of India. India is only the third country following Australia and New Zealand to have such a system.

KGS will appeal against Green Tribunal verdict

KGS Aranmula International Airport Limited [KAIAL] will appeal in the Supreme Court against the verdict of the National Green Tribunal [NGT], said Gigi George, managing director. Addressing a press conference in Kochi, he said that 'The project is very much' on and the first phase of the airport would be operational in 2016 as per the earlier schedule.

Manohar Parrikar seeks National Green Tribunal bench in Goa

Chief minister Manohar Parrikar has sought a bench of the National Green Tribunal in Goa and urged Union environment and forests minister Prakash Javadekar to consider modifying the Kasturirangan report in consultation with Goan stakeholders and to have site-specific buffer or eco-sensitive zones. Parrikar demanded a bench of the NGT in Goa instead of the existing bench in Pune. "We cannot send officers continuously to Pune. We informed the minister that the green bench, instead of being a tribunal, is acting like a high court which is not the role conceived for the green tribunal. More importantly, we cannot operate with the green tribunal in Pune because everyday our officers have to keep on rushing to Pune. This is not acceptable," Parrikar said.

Yettinahole: vedike to approach green tribunal

The Paschima Ghatta Samrakshana Horata Vedike has decided to approach the National Green Tribunal's Southern Bench in Chennai by this month-end against the implementation of the Yettinahole project. Before this, the vedike intends to gather as much material as possible to support its case against the project, which, it said, would endanger the ecological system of the Western Ghats.

Builders hiding behind Green Tribunal's order, claim Noida home buyers

Real estate developers who have projects within a 10-km radius of the Okhla Bird Sanctuary here are using environmental concerns to delay giving possession, buyers of these units have alleged. A National Green Tribunal order in April this year had stopped all new constructions within the 10-km radius pending the final order of the Supreme Court in a related case. The NGT had, however, allowed ongoing construction to be completed, but said that completion certificates could only be given as per the final order of the apex court in the Goa Foundation case.

Green Tribunal panel visits port development area

A six-member expert committee, constituted by the National Green Tribunal, visited the site of the third-phase expansion of the fisheries port at Old Bunder area here. It was constituted after a case was filed by Octavia Albuquerque and others, to look into the allegations that a creek was filled up in violation of the Coastal Regulation Zone (CRZ) rules. The construction of the wharf, initially estimated to cost Rs. 57.6 crore in 2011, was halted with the Principal Bench ordering status quo on the petition in April. In its May 13 order, the Tribunal constituted the committee to inspect the site in question and file a comprehensive report on the issue.

National Green Tribunal guidelines on Ralamandal forest to hit real estate boom

If National Green Tribunal orders are followed, townships in vicinity of Ralamandal Wildlife Sanctuary will land in troubled waters. Taking up the cause of conservation of the forest, the green body has banned construction within 10km radius of the sanctuary thereby bringing the townships at bypass road under scanner.

National Green Tribunal orders ignored, farming with sewage continues

Despite orders issued by National Green Tribunal (NGT), vegetables irrigated with sewage water are still being sold in Bhopal markets. So far, the administration has only managed to destroy contaminated vegetables growing over six acres of land in Shahpura and near Coach Factory. The remaining 25 acres worth of vegetables cultivated with sewage water are yet to be destroyed. NGT had ordered agriculture department to ensure no vegetables growing from sewage water should reach markets and be consumed.

National Green Tribunal court stays road widening

The National Green Tribunal has stayed the Rs 30 crore road-widening project in the Kothaguda reserve forest area and has also stayed the construction of a Rs 200 crore sewage treatment plant (STP) in the Lingamkunta Lake at Serilingampally. The Botanical Gardens road-widening project would have killed one entire stretch of the reserve forest area. It is illegal to widen the road from 80 to 100 feet, and the STP is built on the full tank level (FTL) of the Lingamkunta Lake, the tribunal said.

Green Tribunal to hear Coke plea against UP Pollution Board tomorrow

The fate of Coca-Cola's bottling plant at Mehdiganj near Varanasi is now in the hands of the National Green Tribunal (NGT) which will hear a petition, filed by the beverages major. Coca-Cola has filed a petition before NGT against the order of the Uttar Pradesh Pollution Control Board leading to closure of one of the bottling plants of the American soft-drink company. The UP Pollution Control Board had ordered shutting down the plant for various violations, including groundwater extraction, which has caused problems for Coca-Cola earlier as well.
